Experience Part of the team that represented Bank of America Corp. before the US Supreme Court in Bank of America Corp. v. City of Miami . The case concerned the proper test for proximate cause under the Fair Housing Act, and the court unanimously adopted the test for proximate cause advanced by Bank of America. Obtained denial of motion for class certification and then a grant of summary judgment on behalf of multiple mortgage lenders in multidistrict litigation in Arizona federal court. Mediated and arbitrated claim under representations and warranties policy insuring the sale of a healthcare company, including successfully moving to dismiss claimant’s party-appointed arbitrator for cause due to bias before obtaining a favorable settlement. Obtained an extraordinary writ of certiorari from the South Carolina Supreme Court to review and then unanimously reverse a trial court order denying motion to dismiss in consolidated cases brought by five South Carolina counties. Served as part of the national litigation strategy team for an automotive company’s asbestos-related litigation. Obtained dismissal of Truth in Lending Act claim against company that finances energy efficient home improvements. Represented clients in government investigations pursued by the Consumer Financial Protection Bureau and US Department of Housing and Urban Development.
