<p><!-- x-tinymce/html --></p> <p>Robert Wilson is a Partner with over 25 years of experience litigating hundreds of complex wage and hour class and PAGA representative actions under California’s Private Attorneys General Act (“PAGA”). Robert represents both employees and employers in cases involving claims involving meal periods, rest breaks, overtime, regular rate of pay calculations, minimum wage, final wages, business expense reimbursements, waiting time penalties, and wage statement violations (among other issues). Robert also handles single plaintiff employment claims including discrimination, harassment, retaliation, wrongful termination, and failure to accommodate. His cases are often high stakes, "bet-the-company," cases that settle in the seven and eight figure range on behalf of thousands of employees. Robert also provides general employment advice and counseling to employers in order to avoid expensive wage and hour class actions and PAGA lawsuits.</p> <p>Robert was co-lead counsel in the landmark <em>Brinker v. Superior Court (Hohnbaum) </em>California Supreme Court case. The <em>Brinker</em> decision addresses an employer’s meal period, rest break and record keeping requirements under California’s Labor Code and Wage Orders and is the leading authority in California on the subject. The case is cited in virtually every wage and hour brief filed today and was the catalyst for wage and hour compliance lawsuits. Robert also has obtained other appellate court victories that have shaped the entire industry over the course of his career.</p> <p>Robert holds 5 active bar licenses in California, New York, Massachusetts, Arizona and in Washington, D.C. Robert was a Partner at Biglaw defense firms Fisher Phillips and Gordon Rees representing employers before switching to the plaintiff side three years ago. Robert has received many awards from his peers over his career including an "AV Preeminent" rating from Martindale-Hubbel, "Top Lawyer in Employment Law" from <em>San Diego Magazine,</em> and he received a<em> "</em>Superb Attorney" rating from Avvo. </p>
