<p>Welcome to the Law Office of Patricia “Pogo” Overmeyer. I have practiced various areas of family law since 1994, as a family law attorney (1994-1999 and 2007 to present), a tribal court judge for the Tohono O’Odham Nation (1999-2003), and as an Assistant Attorney General for Child Support Enforcement (2004-2007). </p> <p>I currently place an emphasis on military issues in family law, whether for the active duty servicemember, veteran or their family members. Understanding the intersections of civil family law and military issues is similar to solving a Chinese puzzle. This unique area of family law has many difficulties, whether it be the division of military retirement, invoking the Servicemembers Civil Relief Act (SCRA) while serving in a war zone, the relocation of the servicemember resulting in a change in parenting time, and accusations of domestic violence due to military service (PTSD and any other type of mental illness) which have resulted in civil orders of protection and/or the involvement of Family Advocacy. </p> <p>I also prepare Military Divisions of Retirement (MDRO) on a regular basis for other attorneys and have had the pleasure to hired as co-counsel on cases so as to ensure the military issues are properly addressed.. Dividing the military retirement in a divorce case requires understanding not just the state law but also the federal law as it relates to the military retirement. DFAS requires a particular type of retirement order and will routinely reject the order if it does not follow all the required language. Understanding this is vital to ensuring the military retirement is properly divided. And this also includes whether or not the ex-spouse will be awarded the Survivor Benefit Plan, as well as who will pay for it.</p> <p>I look forward to talking with you about your case, helping you decide what is the best option in your case and helping you to resolve the issues in your case.</p>
